TERMS
- Agreement to the conditions
SAS Montaigne Studio with share capital of €20,000 is a subsidiary of Financière CA.MA.RO , a company with share capital of €6,850,000, and owner of the ARVILS brand.
Our manufacturing and sales are subject, without exception, to these general conditions of sale which prevail over the general conditions of purchase of the buyer.
Any order for products implies, on the part of the Customer, acceptance of these general conditions of sale.
SAS Montaigne Studio reserves the right to deviate from certain clauses of these general conditions of sale, depending on the negotiations conducted with the Client, by establishing Specific Conditions of Sale.
These conditions apply to all our sales made worldwide.
They apply from the date of publication appearing at the bottom of this document and will apply until the publication of a new version.
- Site Products ARVILS
The Products offered for sale by ARVILS are tailor-made products and/or customizable products upon specific order from the Customer.
The illustrations of the jewelry presented have no contractual value.
The characteristics of the jewelry on the site are provided for information purposes only. You should not purchase without obtaining professional advice from us.
Although we make reasonable efforts to update the information on our site, we do not guarantee that the content on our site is accurate, complete or up-to-date.
- Intellectual property
SAS Montaigne Studio retains all industrial and intellectual property rights relating to the products, photos, videos and technical documentation which may not be communicated or reproduced without its written authorization.
SAS Montaigne Studio reserves the right to oppose, cease or seek compensation for any use that it deems unfair, constituting an act of commercial parasitism, or contrary to its image or rights.
- Orders
4.1 Any order placed in application of these general conditions of sale must imperatively include the following information:
- The date of the order.
- The Client’s business name.
- The references of the SAS Montaigne Studio quote for the products ordered.
- The exact delivery address.
- The delivery contact and their telephone number.
- The billing address.
- The contact details of the Client and the recipient (telephone number and email address).
- The desired delivery date.
– Sales are only complete after express written acceptance of the Customer's order by SAS Montaigne Studio, which will ensure in particular the feasibility of the products requested.
– Receipt of the order and its acceptance are confirmed by sending an email to the address indicated by the Customer in the order.
4.2 Price-Payment
SAS Montaigne Studio reserves the right to modify the price of its products or associated services at any time. Prices are subject to change, for example, in the event of changes in the price of raw materials, limited-time promotional offers and/or changes in regulations relating to eco-contributions or other taxes.
All our prices are displayed all taxes included. The applicable VAT appears when the customer enters the country in which the order will be delivered.
Our invoices are payable in cash upon receipt.
Tax refund service is not available
It is specified that Montaigne Studio issues electronic invoices. They serve as original invoices. By accepting these general conditions of sale you agree to receive invoices in electronic format.
4.3 Place and Methods of Delivery
Delivery will be made to the address indicated by the Customer on the Order form by hand delivery, against discharge, of the jewelry to the Customer. All deliveries will be accompanied by a delivery slip.
SAS Montaigne Studio undertakes to deliver products that comply with the order and in packaging conditions sufficient to preserve their integrity.
Shipments will be made by partner carriers outside SAS Montaigne Studio
The delivery price is included in our commercial offer.
If the delivery of the order is delayed by an event beyond our control, we will inform you as soon as possible and will use steps to minimize the consequences of the delay. If we do not deliver within thirty (30) days following the date of the official Confirmation of the Order or any other deadline that we indicate, you can cancel the order and obtain a refund of the sums that you have paid us for any products that you have not received. You will simply have to make the request on the following email: contact@arvils.com
In any event, your right to cancel an order and receive a refund of any amounts you have paid to us for any products you have not received is your sole remedy if we fail to deliver the order in question.
Our carrier will require a handwritten or electronic signature from you, or from any person at the delivery address provided, to confirm delivery of the package, after which the risk and responsibility for the products you have purchased will pass to you. If you have specified a recipient other than yourself for delivery, you agree that a signature by said recipient (or a person at the delivery address) constitutes evidence of conclusion of the sales contract by SAS Montaigne Studio, implying a transfer of responsibility to the recipient's address, as if the product had been delivered to you.
4.4 Missed Deliveries.
If the person is not present to take delivery of the order at the agreed address and date, our delivery providers will leave you a note informing you of how to arrange a new delivery which will be billed to you.
4.5 Reservations
Upon receipt of the products, it is the Customer's responsibility to check, in the presence of the carrier , the good condition of the products delivered. The Customer must issue any reservations, in the presence of the carrier, on the carrier's delivery note, clearly specifying the disorder and send it to SAS Montaigne Studio by email to the following address within 12 hours: contact@arvils.com
No claim may be validly accepted in the event of non-compliance with these formalities by the Client.
SAS Montaigne Studio will replace as soon as possible and at its own expense, the products delivered whose lack of conformity has been duly proven by the Customer and for which the above procedure has been scrupulously followed.
4.6 Right of Withdrawal and Returns
- Right of Withdrawal
In accordance with article L221-18 of the Consumer Code, you have 14 days from receipt of your order to exercise your right of withdrawal without having to provide reasons or pay penalties.
- Return Conditions
To exercise your right of withdrawal, you must notify us of your decision by a clear statement, via the withdrawal form .
Returned items must be in their original packaging in perfect condition. Any item returned damaged, used, incomplete, soiled, or with a damaged or missing seal will not be eligible for a refund.
- Return Procedure
For the return of items, you must use only Ferrari Expéditions France, 51 rue d'Aboukir, 75002 Paris – France, +33149966060, to ship the item. You must imperatively declare the real value of the item to Ferrari Groupe at the time of shipping. The return costs are at your expense, unless otherwise indicated by us.
- Refund
Refunds for returned items will be issued upon receipt of the items if all of the above conditions are met. The refund will include the initial delivery costs (except for additional costs if you have chosen a more expensive delivery method than the standard delivery method offered).
We reserve the right to withhold reimbursement until we have received the goods back.
- Exclusions
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalized. These exceptions will be clearly indicated to you before the conclusion of the sale.

4.7 Voluntary Return Policy
The Customer does not benefit from such a right because the jewelry is made, at the customer's request, to measure and/or personalized.
- Payment by Credit Card, Debit Card or bank transfer.
To pay for your purchases with us, you can use your credit card, debit card or make a transfer. We accept CB, Visa©, MasterCard©, American Express©, ApplePay©. If your card is issued by a bank outside France, it must be an international bank card.
When you make a transaction, you do so according to the banking security and authentication standards specific to your bank. By providing your banking information to SAS Montaigne Studio, you agree that we will proceed with the secure transaction and authorize your bank to debit your account, even without an invoice signed by you.
The sales contract is concluded at the time we debit your bank card, if this is done before the dispatch of your order.
5.1 Payment by PayPal
At SAS Montaigne Studio, we make your purchases easier by accepting payments via PayPal, a convenient and secure option.
When you validate your order, choose to pay via PayPal and let yourself be guided to their user-friendly and reliable platform. Once your choice is confirmed, we will ensure the security of your transaction.
Your order will be shipped as soon as we have verified your payment method, obtained authorization to charge your credit card or received confirmation from PayPal. We also ensure that your order complies with our General Conditions of Sale for your peace of mind.
- Limitation of liability clause
Our products are custom-made from raw materials of commercial and fair quality. By express agreement, we cannot be held liable in the event of a manufacturing defect, whatever the cause, beyond the free replacement of our supply recognized as defective by us and returned by the customer. We cannot be held liable for the payment of any compensation.
All synthetic diamonds weighing more than 0.50 ct are sold with a certificate of authenticity issued by one of two laboratories with an indisputable reputation: IGI; GIA.
All our jewelry is set exclusively with 18 carat gold.
SAS Montaigne Studio reserves the right to deviate from this clause with the client's agreement.
- Site Administration
We reserve the right, in our sole discretion, to (1) monitor the Site for violations of these Terms; (2) take appropriate legal action against anyone who violates applicable laws or these Terms; (3) remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (4) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site and Services.
We do not guarantee that the Site will be secure or free from bugs or viruses even though we take all appropriate measures to combat them.
You are responsible for configuring your information technology, computer programmes and platform to access the Site and you should use your own anti-virus protection software.
Without limiting any other provision of these Terms and Conditions, we reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Site and Services (including blocking certain IP addresses), to any person for any reason, including, without limitation, for breach of any representation, warranty or covenant contained in these Terms and Conditions or of any applicable law or regulation.
If we determine, in our sole discretion, that your use of the Site/Services violates these Terms and Conditions or any applicable law or regulation, we may terminate your use of or participation in the Site and Services or remove any content or information you have posted at any time, without warning, in our sole discretion.
- Personal Data
Our top priority is the security of customer data and as such we may only process a minimum of user data, to the extent that this is absolutely necessary for the maintenance of the website. The information collected automatically is used only to identify potential cases of abuse and to establish statistical information on the use of the website. This statistical information is not aggregated in such a way as to identify a particular user of the system.
You can visit the Website without telling us who you are or revealing any information that would allow someone to identify you as a specific, identifiable individual. However, if you wish to use certain features of the Website, or if you wish to receive our newsletter or provide other information by filling out a form, you may provide us with personal data, such as your email, first name, last name, city, place of residence, organization, telephone number, date of birth. You can choose not to provide us with your personal data, but then you may not be able to take advantage of certain features of the Website. For example, you will not be able to receive our Newsletter or contact us directly from the Website.
- Applicable law and competent jurisdictions
These general conditions of sale and the purchase and sale transactions resulting from them are governed by French law.
ALL DISPUTES TO WHICH THESE TERMS AND CONDITIONS AND THE AGREEMENTS RESULTING FROM THEM MAY GIVE RISE, CONCERNING THEIR VALIDITY, INTERPRETATION, EXECUTION, RESOLUTION, CONSEQUENCES AND FOLLOW-UPS WILL BE SUBMITTED TO THE COURT on which the registered office of SAS Montaigne Studio depends.
